- The submission of position details to Change Jobs constitutes an acceptance by the Advertiser of these terms and conditions in full.
- In this document:
- "Change Jobs", "we, "us", and "our” means the business known as Change Jobs.
- "Advertiser", "you" and "your"" means the individual, partnership, company or other entity placing advertising with Change Jobs.
- Confidentiality
- Contract pricing and other terms are commercially sensitive and confidential. Advertiser agrees not to divulge any details to third parties (other than its solicitors and auditors for reasonable purposes) under any circumstances (other than as may be required by the Courts) without specific written permission from Change Jobs.
- Copyright
- 3.1 This website contains copyright material, trade names and other proprietary information, including but not limited to, design, text, software and graphics. The entire contents of this website are protected by copyright law. Change Jobs, or its licensors, own copyright and/or database rights in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part except as provided below.
- 3.2 You may download information from the website for your own personal use only. Except as otherwise expressly permitted under copyright law, no copyright, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without our express permission and that of the copyright owner. In the event of any permitted copying, redistribution or publication of copyright material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyright material.
- Submission and content of vacancy details
- 4.1 Delivery: Unless otherwise agreed in writing by Change Jobs, vacancy details must be transmitted either via a job distribution posting tool or directly onto the Change Jobs website.
- 4.2 Multiple jobs: Vacancy submissions must relate to a single job or a requirement for multiple identical jobs. We reserve the right to refuse listings for multiple, non-identical vacancies.
- 4.3 Description length: Vacancy descriptions must not exceed 3500 characters. We reserve the right to paraphrase or otherwise reduce submissions which in our judgment are excessive.

- 5.1. Change Jobs does not make any representation as to the security, quality or propriety of any website which may be accessed through this website. Linked websites accessed through website are independent websites over which Change Jobs does not exercise any control, whether financial, editorial or of any other kind and are not in any way endorsed by Change Jobs.
- 5.2. Accordingly Change Jobs has no responsibility or liability to you in respect of any products or services purchased or obtained by you from any such linked website nor in respect of the use of any personally identifying information by any such linked website or its owner.
- Legal
- Vacancy details must comply with all laws and ethical rules to which the Advertiser is subject. These include, but are not limited to, the following.
- 6.1 Genuine vacancy details: Vacancies advertised must be currently available and details verifiably accurate. Generic job listings cannot be accepted for publication.
- 6.2 Discrimination: Vacancy advertisements cannot discriminate on the basis of race, colour, nationality, ethnic or national origins, disability, marital status, age, or trade union membership (save to the extent specifically permitted in law).
publishing period: Jobs can be posted by yourselves anytime however if the job posting is submitted to Change Jobs it will be admitted by 12pm the following day. Details will remain on the site for 14 days business days (plus intervening weekends and English bank holidays). - 6.3 Acknowledgement of applications: Direct contact must be made as soon as possible with all candidates who submit an application or CV in response to a vacancy advertisement.
- Publication of vacancy details
- 7.1 Deadline and publishing period: Jobs details will remain on the site for 14 days.
- 7.2 Alterations and corrections: We make whatever amendments we consider appropriate or necessary in the course of editing all vacancies published on our site in order to maintain a high quality of presentation and to aid keyword searching by web site visitors. Editing of vacancy submissions will take place without prior consultation with the Advertiser.
- 7.3 Refusal to publish: Change Jobs in the interests of maintaining the quality of its web site reserves the right to refuse publication of vacancy submissions without providing any reason to Advertiser.
- Advertising rates & minimum invoice
- 8.1 Vacancy listings: Vacancy listings will be charged at the prevailing rate unless varied by a specific advertising agreement. Change Jobs reserves the right to amend the pricing rate card without prior notice.
- 8.2 Contracted listings: Where the Advertiser has agreed to supply a minimum number of vacancy listings each month and does not meet the agreed number during a particular month, the Advertiser is liable to pay in full for the agreed minimum number of listings.
- 8. Billing and payment terms
- 8.4 VAT: VAT shall be charged to all Advertisers at the rate applicable.

- 9.1 Terms: Vacancy listings will not be published until payment is received by us in full, unless otherwise agreed. Ad-hoc and contracted Advertisers will be billed calendar monthly in arrears. Payment is due within 14 days of the invoice date unless otherwise agreed in advance of publication.
- 9. Warranty and Indemnity
- 9.3 Suspension of account: Change Jobs may suspend an Advertiser’s account and withdraw or refuse publication of all vacancy submissions where the Advertiser’s account is in arrears. Any fees for advertising under contract will continue to accrue during the period of suspension and remain payable, regardless of the volume of advertising published during the period.
- Warranty and Indemnity
- 10.1 The Advertiser warrants to Change Jobs in relation to each vacancy submission, that the vacancy details represent a genuine vacancy and that all information supplied is accurate complete and true in all respects and that the publication of the vacancy details and the reproduction of the whole (or a substantial part of) the text submitted will not breach any agreement or infringe or violate any copyright, trade mark or any other right of any person or render Change Jobs liable to any proceedings whatsoever.
- 10.2 The Advertiser shall at all times keep Change Jobs fully and effectively indemnified against any liability which Change Jobs may suffer or incur as a result of publishing vacancy details, and against any claim for infringement of any intellectual property or other third party rights.
- Liability
- 11.1 Due to the nature of the Internet, there may sometimes be delays or interruptions to our normal service for reasons beyond our control. Change Jobs shall not be held liable for any losses arising from such events, and advertising fees shall remain payable in full.
- 11.2 Change Jobs makes no warranty that www.change-jobs.com (or any website that is, or may become linked to this website) is free from computer viruses, "cookies", or any other malicious or impairing computer programmes and/or that the Site shall operate uninterrupted and error-free.
- 11.3 Change Jobs accept no responsibility for the loss of copy, data or other materials which the Advertiser supplies to it. The Advertiser shall be responsible for retaining in their possession sufficient quality and quantity of such materials for their purposes.
- 11.4 Under no circumstances shall Change Jobs be liable to the Advertiser whether under this agreement or in tort (including negligence or breach of statutory duty) misrepresentation or otherwise howsoever for pure economic loss, losses incurred by any client of the Advertiser or any third party, loss of profits (whether categorised as direct or indirect), losses arising from business interruption, loss of business revenue, goodwill, anticipated savings, wasted management or staff time, loss or corruption of data or any other form of consequential loss.
- 11.5 Subject to the above Change Jobs total liability (whether in contract, tort or otherwise) under or in connection with the publication of vacancy submissions shall under no circumstances exceed 200% of the total fees (excluding any VAT duty sales or similar taxes) paid or payable by the Advertiser to Change Jobs during the six month period immediately preceding any claim.
- 11.6 Change Jobs does not verify or guarantee any Applicant's details whether forwarded to the Client via Change Jobs or otherwise. Change Jobs accepts no responsibility as to the suitability of Applicants who respond to Advertisements or Services.
- 11.7 Change Jobs does not act as an employment agency merely as an advertising means.
- 11.8 The Client shall satisfy itself as to the suitability of any Applicant and shall take up any reference provided by the Applicant before engaging any such Applicant.
- 11.9 The Client shall be responsible for obtaining all work, or other permits, for the arrangements of medical examinations and/or investigations into medical history of any Applicant, and shall satisfy itself of medical or other requirements or qualifications required by law.
- 11.10 Change Jobs does not accept liability, of any description, however arising, for any loss or damage caused to any Client, or any other third party, arising from any virus or other impairing computer program contained in any CV submitted by any Applicant.
- Third parties
- 12.1 The agreement reached pursuant to these terms and conditions is personal to the parties hereto and the Advertiser may not without Change Jobs previous consent in writing assign the agreement evidenced by these terms and conditions in whole or in part.
- 12.2 A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the arrangements pursuant to these terms and conditions but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
- Force majeure
- 13.1 Except with respect to obligations to pay fees under these terms and conditions, force majeure means anything outside the reasonable control of a party including but not limited to acts of God, fire, storm, flood, earthquake, explosion, accident, acts of the public enemy, war, rebellion, insurrection, sabotage, epidemic, quarantine restriction, labour dispute, labour shortage, power shortage, ceasing to be entitled to access the internet for whatever reason, server crashes, deletion, corruption, loss or removal of data, transportation, embargo, failure or delay in transportation, any act or omission including laws, regulations, disapprovals or failures to approve of any Government or Government agency.
- 13.2 If a party is wholly or partially precluded from complying with its obligations by force majeure, then that party's obligations to perform in accordance with these terms and conditions will be suspended for the duration of the force majeure.
- 13.3 As soon as practicable after an effect of force majeure, the party affected by force majeure must notify the other party of the extent to which the notifying party is unable to perform its obligations under this Agreement.
- Law
- If not actually the case, the contract under which you use this website shall be deemed to have been made in England and the construction, validity and performance of these terms and conditions of use shall be governed in all respects by English law and the English courts shall have non-exclusive jurisdiction in respect of any dispute between you and Change Jobs concerning your use of this website.
These terms and conditions apply from 25th September 2006 and replace any previous terms and conditions. We reserve the right to amend these terms and conditions from time to time.
